"ImClone Systems (IMCL-Nasdq) is delaying the release of Q4 and 2002 results, and won't file its 10-K on time. The reason: The need to restate financial statements to reflect the impact of potential withholding tax liability on the exercise of company stock options and warrants issued to former CEO Sam Waksal due to his non-payment of NY state income taxes and possible non-payment of federal income taxes.

Potential charge against IMCL's past results will be at least $23.3 million, the company said.

"Tempering the Victory Party for ImClone"

The ImClone Systems (IMCL:Nasdaq - news - commentary - research - analysis) news we've all been waiting for! For now, at least...

German drugmaker (and ImClone partner) Merck KGaA said this morning that its highly anticipated Erbitux clinical trial was positive, according to an independent review of the data. The announcement essentially confirms preliminary findings released by Merck last December that found Erbitux to be an effective treatment for colon cancer patients.

Merck says it plans to file an Erbitux application to European regulators in mid-2003, as expected. And if all goes well, Erbitux should hit the European market in 2004.

Now, how does this help ImClone?

Hard to say, yet. Merck is providing zero details about its study, as expected. We'll have to wait for the June 1 meeting of the American Society of Clinical Oncology for the real data.

The Merck study, in 330 colon cancer patients, has two arms. Half of the patients received Erbitux alone, and the other half was given a combination of Erbitux and chemotherapy. Merck is not yet telling anyone how the two arms of the study performed relative to each other.

This is pretty important for ImClone. Recall, its original filing to the FDA was based on using Erbitux in combination with chemotherapy. The only way that rejected filing can be salvaged is if the Merck study's combination arm performed better than the arm using Erbitux alone.


Potential Plan B
If it turns out that Merck's monotherapy arm is the only part of the study yielding positive results, then that would likely force ImClone to Plan B: refiling Erbitux to the FDA as a monotherapy treatment for colon cancer. To do that, it would include the Merck data, but that won't be enough. The FDA will also require new data from a monotherapy study now under way in the U.S. Bristol-Myers Squibb (BMY:NYSE - news - commentary - research - analysis) is conducting that study, which should finish up this summer. If positive, ImClone and Bristol-Myers could refile Erbitux by the end of the year

Now, as I reported last October and then again in November, my sources tell me that the Erbitux-alone arm of the Merck study did yield positive results. (I'm hearing patient response rates in the low double-digits.) But the combination arm of the study didn't perform significantly better, say my sources.

If this turns out to be correct -- and I guess we'll have to wait for the ASCO meeting to know for sure -- it likely means that ImClone will move on Plan B. No official word out of ImClone so far.

For investors who have stuck with Erbitux through thick and thin, seeing a clear path that gets the drug to market anytime is a victory. Today's Merck news, then, is a cause for celebration. But a monotherapy indication for the drug is not as lucrative as the original plan to seek a combination label.

Also at ASCO, we'll see data on a competing colon cancer drug, ABX-EGF, from Abgenix and Amgen. This data should allow for some pretty interesting head-to-head comparisons between ABX-EGF and Erbitux.

Imclone! Uma das acções que mais me fez sorrir este ano! O padrão dos últimos tempos tem sido de uma regularidade espantosa: Subida forte, seguida de consolidação durante alguns dias, depois novo disparo e assim sucessivamente... E é como tu dizes, os "intradays" chegam a ser arrepiantes.

É curioso ver como as "biotechs" têm estado particularmente bem nos últimos tempos e muitas vezes elas funcionam como "leading indicators", por isso há que estar atento.

Desenhando uma figura interessante, vai consolidando e subindo, até quebrar a LTD lp e por lá se tem mantido, terá a construir nova consolidação?
Um RSI 14 a 67, não parece incomodar, proxima resistência 20.50.
Vou acreditando até mostrar esta força, não é que por vezes não assuste com os seus intraday´s demasiado volateis.
