AUSTIN, Texas -(Dow Jones)- The Texas attorney general is suing Merck & Co. (MRK), alleging the pharmaceutical giant bilked Texas out of millions of dollars in Medicaid payments by misrepresenting the safety of its Vioxx painkiller.

"The people of Texas have been cheated and defrauded by Merck," Attorney General Greg Abbott said Thursday. "We are suing Merck to get our money back."

Abbott said during a news conference that Texas is the first state to file such a suit against Merck regarding Vioxx, although a flurry of personal-injury lawsuits have been filed against the company nationwide.

Abbott said he considers it likely that other states will file similar suits against Merck.
